Nitty Gritty


1.   DEFINITIONS

The Client is the person that has signed the booking form on behalf of the booking party however the obligations of the Client apply to all members of the booking party.

The Agent is Dubai Shenanigans.

The Supplier is the contracted party used to fulfill an activity or service of the Program.

Deposit means the amount of monies set out in the Program.

The Program refers to the selected activities and or entertainment and or accommodation and or services as confirmed in the booking and subsequently reconfirmed in the Booking Confirmation email. The Agent reserves the right at any time before a booking is accepted by the client, to withdraw or change these conditions if necessary.

 
2. COSTINGS AND PAYMENT

The cost of the Program is as detailed in the Booking Confirmation. The Agent reserves the right to change the price of the Program at any time prior to the Booking Confirmation. The Client accepts that pricing and availability may expire over time. The Client accepts responsibility for paying for all members of the booking party. The Deposit (which is non refundable unless otherwise agreed in writing) as detailed in the Booking Confirmation is payable on booking. The Program remains unconfirmed until the deposit has been received. The remaining balance is payable a minimum of 7 days prior to the commencement of the Program. Failure to make payment on the due dates will entitle The Agent to cancel the Program without penalty and will be treated as a cancellation by the Client. No payment shall be deemed to have been received until the Agent has received cleared funds.

 
3. BOOKINGS AND CANCELLATIONS

A booking has been made once the Client receives a Booking Confirmation email with details of the agreed Program and the full payment has been taken. The Client must check that the Booking Confirmation matches what was booked and then return the signed booking form. In the absence of a signature, the Client accepts that an email is confirmation of commitment to progress with the agreed Program. If the Client seeks to amend the Program, the Agent will establish whether this is possible and advise the Client in writing of any additional cost, which will be amended in the Program. If the client wishes to cancel any booking, the Agent should be advised immediately in writing. If the cancellation is made less than 7 days prior to the Program, the Agent shall be entitled to retain the deposit.


4. BOOKING AND PROGRAM ALTERATIONS

The Program is based on current schedules and service details and as a result, minor changes to be made from time to time. Wherever possible the Agent will notify the Client of any such changes before commencement of the Program. In the event of significant changes to or cancellation of the Program prior to the date of the Program, the Agent will as soon as is reasonably possible notify the Client. In these circumstances the Client may accept the change and if applicable a refund of the difference in price between the price of the Program purchased and that of the substitute Program.  Where necessary and if possible, an alternative Program will be offered.  If the Client wishes to make major changes to the Program including the numbers of the booking party or the dates of the planned Program, this request may be treated as a cancellation of the initial booking and the booking of a new Program. In such cases cancellation charges may be incurred. The Agent will advise the Client upon receiving request/s to make amendments if this is the case. If the booking party arrives at any part of the Program with an increased number of persons to those detailed on the booking form, they may be immediately charged with any additional costs.

 
5. AGENT RESPONSIBILITIES

The Agent will use all reasonable care in the selection and use of Suppliers of services and activities forming part of the agreed Program. The Agent accepts responsibility for claims by the Client where The Agent fails to provide the proper performance of the services forming part of the confirmed Program. The liability shall be limited to the net cost of the element of the Program found to be deficient plus all reasonable local transport costs pertaining to that element of the Program only. Receipts will be required in the case of transport costs. The Agent does not accept liability in the following circumstances:

If the Client or any member of the booking party are at fault
Any failure by any booking party member to observe safety instructions and Program guidelines
Any failure by any booking party member to observe schedules and advised timekeeping
If the failure is the fault of someone else not connected with providing services, which make up the agreed Program
Any change in the Program as instructed directly to any Suppliers or Services by the Client post confirmation without The Agent’s written acknowledgement of change, including change in numbers or details of the booking party
Any unusual or unexpected circumstances beyond the control of the Agent or its Suppliers even if they had used all due care, could not foresee
Any instance of inappropriate behaviour on the part of the Client or any member of the booking party

 
6. CLIENT RESPONSIBILITIES

The Client must ensure that all terms and conditions are clear and that members of the booking party are informed about these terms and conditions and the booking/Program details. The Client is responsible for the group. The Client must inform the Agent in writing of any special requests which any of the booking party have so that arrangements can be made as far as reasonably possible. The Client will ensure that all members of the booking party are over 18 years of age, suffer no disabilities or conditions that may impair, restrict or endanger their involvement or that of other members of the booking party’s involvement in the Program. The Client agrees and progresses with all payment timetables as set out in the Booking Confirmation. The Client will ensure that all members of the booking party comply with all activity/element timetables of the Program. Failure to keep to the timetables may result in either discontinuation of the event/activity or cancellation of the Program; in either event the Agent will not be liable for any refund, compensation or any other costs that may be incurred. The Client will ensure that all members of the booking party act at all times in a safe, responsible and courteous manner and comply with all safety procedures. If the booking party is found to be behaving in a way that results in affecting the standard performance and or presentation of the Agent’s Suppliers and enjoyment / experience of other guests, groups may be required to leave the premises. If this is the case, the Program may be immediately terminated and the Client will immediately forfeit all costs and any right to compensation, whether or not the Program has been completed.
